These terms govern your use of the Overshoulder website and desktop application. Using either means you accept them.
Overshoulder is a desktop application that captures images of your screen, analyses them, and displays guidance indicating which on-screen control to use next. It is an assistive tool. It does not control your computer, click on your behalf, or modify your files.
The application identifies controls by interpreting an image. It can be mistaken, and it has no knowledge of the value or reversibility of what a control does. You are responsible for every action you take on your own computer. Check the highlighted control before clicking anything that deletes, overwrites, sends, publishes, or spends. The application shows a warning when it believes a step is destructive, but you should not depend on it doing so.
The application captures whatever is visible on the display you are using. If that includes confidential information, other people's personal data, or material you are under an obligation to protect, capturing it may breach that obligation. You must not use Overshoulder where doing so would break a duty of confidentiality, an employment policy, or any law that applies to you. Close or hide such material first.
You agree not to use Overshoulder:
The screen-share exclusion feature exists so that a working overlay does not clutter a shared screen or a recording. It is not provided to help you conceal assistance where assistance is not permitted.
You must be 16 or older to hold an account. You are responsible for keeping your password to yourself and for anything done through your account. Tell us promptly if you believe someone else has access to it.
One person, one account. Do not share credentials, and do not create additional accounts to obtain more free usage than a single account allows.
You may delete your account at any time from the account page. We may suspend or close an account that breaches these terms.
Paid plans, where offered, are billed in advance for the period stated at the point of purchase. Usage allowances are stated per plan and do not carry over. You may cancel at any time and will retain access until the end of the period you have paid for. Where a plan describes an allowance of tasks, a task means one question and the analysis required to answer it.
We do not promise that the service will be uninterrupted. It depends on third-party infrastructure and may be unavailable for maintenance, for reasons outside our control, or because we have chosen to change it.
The Overshoulder software, name, and branding remain ours. You keep every right you already had in your own screen contents and your own work; using the application grants us no licence to it beyond what is technically required to answer the question you asked.
To the fullest extent the law allows, the service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or exemplary damages, nor for lost profits, lost data, or work you have to redo. Our total liability arising out of these terms will not exceed the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
You may stop using the service at any time. We may suspend or end your access if you breach these terms, or if we discontinue the service.
We may update these terms. If a change is material, the date at the top will change. Continuing to use the service after that means you accept the revised terms.
These terms are governed by the laws of the jurisdiction in which Overshoulder is established, and the courts of that jurisdiction have exclusive jurisdiction, except where consumer protection law in your country of residence gives you the right to bring proceedings locally.
